David Reid House Bill 409 Clarifies School Bus Passing Rules on Divided Highways

Yellow school bus stopped on a rural road with children crossing

RICHMOND — In a rare display of unanimous agreement, the Virginia General Assembly has approved House Bill 409, a measure clarifying traffic rules for passing stopped school buses on divided highways, access roads, and certain driveways. The bill, now awaiting action from the governor, promises to eliminate ambiguity in existing law, promoting smoother traffic flow and enhanced road safety through precise legal language.

Sponsored by Delegate David Reid, HB 409 amends Section 46.2-859 of the Code of Virginia. Under current provisions, drivers are exempt from stopping for a school bus if the vehicle is on the opposite roadway of a divided highway, an access road, or a driveway separated by a physical barrier or unpaved area. The legislation explicitly states that this exemption applies regardless of whether the barrier or unpaved area is continuous or segmented to accommodate intersections or turning vehicles. This straightforward clarification addresses longstanding interpretations that could lead to driver confusion, potentially reducing risky maneuvers on busy roadways.

The bill’s journey through the legislature was swift and without opposition. Prefiled on January 12, 2026, and ordered printed ahead of the session’s start, HB 409 was referred to the House Committee on Transportation on January 14. The Highway Safety and Policy Subcommittee recommended reporting it out on January 21 with a 9-0 vote. The full House Transportation Committee followed suit on January 22, approving it 21-0.

The House floor saw rapid progress: first reading on January 26, second reading and engrossment on January 27, and third reading passage via block vote on January 28 at 97-0. Sent to the Senate on January 29, it received a fiscal impact statement from the Department of Planning and Budget that same day. The Senate dispensed with first reading and referred it to the Transportation Committee.

Senate action mirrored the House’s consensus. The committee reported it favorably on February 19 with a 15-0 vote. Constitutional reading was dispensed on second reading via block vote on February 23 (37-0), passed by for the day, and rules suspended. Third reading and passage occurred on February 24 at 39-0 via block vote. Both chambers signed off on the enrolled version on February 26, with the Speaker of the House and President of the Senate affixing their signatures.

Fiscal impact statements issued on January 30 and February 27 indicate the change imposes no additional burdens on state resources, underscoring the bill’s efficiency. By refining existing exemptions without expanding mandates, HB 409 supports practical governance that prioritizes clear rules for everyday Virginians navigating congested highways.

School bus safety remains a cornerstone of Virginia’s transportation policy, with millions of student rides annually protected by vigilant enforcement. This measure ensures drivers can focus on genuine hazards rather than navigating vague statutory language, potentially averting accidents stemming from hesitation or misjudgment. Unprecedented unity across committees and chambers—zero dissenting votes at every stage—highlights the bill’s appeal as a commonsense reform that balances child protection with operational realities of modern roadways.

As the bill awaits the governor’s communication, its passage reflects lawmakers’ commitment to refining laws that directly impact public safety and mobility. Should it become law, Virginia drivers will benefit from unambiguous guidance, fostering safer commutes and freer movement on divided thoroughfares statewide.
