Portsmouth, Danville properties listed for forfeiture in Lucas case: What that means

The federal indictment against state Sen. Louise Lucas and six co-defendants ends with a list of addresses. They are properties in Portsmouth and Danville, plus a bank account, that the government says it will seek to take if the defendants are convicted.

Here is what is on the list and what a forfeiture allegation does and does not mean.

What a forfeiture allegation is

The section is headed "Forfeiture," and it begins: "The grand jury further finds probable cause that ..." Each paragraph that follows is conditional. The defendants, "if convicted," shall forfeit certain property "as part of the sentencing" under Federal Rule of Criminal Procedure 32.2.

In plain terms:

  • It is notice, not a judgment. The indictment tells the defendants what the government intends to pursue. A court would order forfeiture only after a conviction, as part of sentencing.
  • It is tied to specific counts. For racketeering (Count 1), the indictment seeks interests acquired through the enterprise and racketeering proceeds. For money laundering (Count 3), it seeks property "involved in" the offense. For the drug and premises counts (Counts 2, 5, 6) and the firearm count (Count 7), it seeks proceeds and property used to facilitate the crimes. For honest services fraud (Count 4), it seeks proceeds traceable to the offense. It also seeks any firearms or ammunition involved.
  • Substitute assets are possible. If listed property is unavailable, the government says it intends to seek "substitute assets."
  • The list is not exhaustive. The assets "include, but are not limited to," those listed.

Nothing in the indictment says these properties have been seized. The defendants are presumed innocent.

What's not on the list

The Norfolk location at 345 Granby St., Suite A, named in Count 6 as a drug-involved premises, does not appear among the listed forfeiture assets. Neither does the Lucas Lodge address the indictment gives, 1120 Lakeview Dr. The list is expressly non-exhaustive.

Who owns what

The indictment does not state who holds title to each listed property. AVN has not yet reviewed Portsmouth or Danville land records to confirm ownership. The indictment does say Lucas owns Lucas Lodge LLC, Lucas Hospitality LLC and The Cannabis Outlet, "all located in Portsmouth."

Next steps

Contested forfeiture issues are typically resolved after a verdict or plea, as part of sentencing. Third parties who claim an interest in forfeited property can generally file claims in an ancillary proceeding. No court schedule had been made public in the materials reviewed for this story.

Source note: The forfeiture section (pp. 42–44), General Allegations ¶¶A, F, G, J, L, and Counts 5–6 come from U.S. v. Lucas et al., No. 4:26-cr-00075 (E.D. Va.), Doc. 3. The May 6 search is confirmed by the indictment and the DOJ press release (Oct. 22, 2026). Fact gaps: Property ownership has not been verified against land records. The connection of 530 Arnett Blvd. and 801 Freedom Ave. to the case is not explained in the filing. The Southern Bank account holder is unidentified.
