Timeline: Loudoun County, the school boards letter and the Garland memo, 2021 to 2026

Timeline: Loudoun County, the school boards letter and the Garland memo, 2021 to 2026

A 273-page Justice Department report released this week reconstructs how a 2021 federal memo on threats against school officials came to be, with events in Loudoun County at the center. "The 2026 Report to Expose the Weaponization of Government Against Parents in Schools," dated Oct. 5, draws on internal DOJ and FBI emails, the National School Boards Association's own after-action review, a June 2026 roundtable transcript and an October 2025 federal lawsuit against the Loudoun County School Board. The following timeline is assembled from those materials. Where a date or claim comes from a single source, that source is noted. Allegations in the lawsuit have not been proven in court.

May 28, 2021: According to the lawsuit, a 15-year-old Stone Bridge High School student with disabilities is sexually assaulted in a girls' restroom stall by a male student wearing female attire. The suit says the district's chief operating officer emailed then-Superintendent Scott Ziegler and senior staff that afternoon that "the incident at SBHS is related to policy 8040." It says Ziegler emailed School Board members about the allegation the same day.

June 1, 2021: The lawsuit says the student returns to school with no safety plan in place, and the accused student is also in the building.

June 22, 2021: At a Loudoun County School Board meeting where Policy 8040 is under discussion, the student's father, Scott Smith, is arrested. Ziegler tells the meeting, "To my knowledge, we don't have any record of assaults occurring in our restrooms," and says "the predator transgender student or person simply does not exist." The DOJ report says Smith was arrested after challenging that claim. Smith told the 2026 roundtable that he was arrested after a confrontation with another attendee.

August to September 2021: According to the lawsuit, the district's director of school administration presses for a Title IX investigation, and the Title IX coordinator says he is "still operating from an allegation of an attempted sexual assault." On Sept. 8, the student is beaten in a school hallway while another student films it.

Sept. 9 to 21, 2021: The NSBA's review says interim CEO Chip Slaven begins drafting a letter seeking federal help and shares a summary and "egregious examples" with White House adviser Mary Wall.

Sept. 22 to 27, 2021: The DOJ report says White House lawyers forward Slaven's email to the Office of the Deputy Attorney General. One attorney there writes, "This is ridiculous."

Sept. 29, 2021: The NSBA, based in Alexandria, sends its letter to President Biden. Its only Virginia example is the Loudoun meeting, where "an individual was arrested, another man was ticketed for trespassing, and a third person was hurt."

Oct. 2, 2021: DOJ circulates draft documents. Criminal Division attorneys object. The Public Integrity Section chief flags reported threats against Loudoun parents and calls the issue "all very messy and political."

Oct. 4, 2021: Attorney General Merrick Garland issues his memo directing the FBI and U.S. attorneys to convene meetings with local law enforcement within 30 days.

Oct. 6, 2021: According to the lawsuit, the same male student, by then transferred to Broad Run High School, sexually assaults another student there.

Oct. 15, 2021: Ziegler issues a public apology, saying "we failed to provide the safe, welcoming and affirming environment that we aspire to provide."

Oct. 19, 2021: The lawsuit says LCPS begins its Title IX investigation of the May assault.

October 2021: The male student is convicted of sexual battery and forcible sodomy in the Stone Bridge case.

Oct. 20, 2021: The FBI asks agents to apply a new "EDUOFFICIALS" threat tag to school-board threat cases.

Oct. 22, 2021: The NSBA board apologizes for its letter.

Jan. 10, 2022: The DOJ report says the memo's drafter confirms the federal task force is still tracking threats.

April 26, 2022: The lawsuit says LCPS concludes its Title IX investigation, more than six months after opening it.

2023: The DOJ report says Smith's prosecution ended with a pardon from then-Gov. Glenn Youngkin; its footnote cites a September 2023 news report. Smith told the roundtable that the Commonwealth's attorney who prosecuted him was voted out in November 2023.

Jan. 20, 2025: President Trump signs an executive order on government "weaponization." Attorney General Pamela Bondi later creates the Weaponization Working Group and rescinds the Garland memo.

Oct. 24, 2025: The student, now 19, sues the Loudoun County School Board, Ziegler and four other former officials in federal court in Alexandria.

Early 2026: Then-Acting Attorney General Todd Blanche says DOJ moved to intervene in a separate Loudoun lawsuit over boys suspended after objecting to sharing a locker room with a transgender student.

June 11, 2026: DOJ hosts a roundtable with Youngkin, Smith and Loudoun parent Ian Prior. Education Secretary Linda McMahon says Loudoun and four other Northern Virginia districts were placed on reimbursement status for more than $50 million.

Oct. 5, 2026: DOJ issues its report. It concludes that the Garland memo resulted from White House pressure, and it promises to let parents review FBI files opened under it.
