Kelly Convirs-Fowler House Bill 187 Codifies Virginia Beach 10-1 Council Charter
RICHMOND, Va. – Legislation to update the City of Virginia Beach’s charter, reflecting the shift to a city council composed entirely of single-member districts plus a mayor, has cleared both chambers of the Virginia General Assembly and now awaits final action following the governor’s recommendations.
House Bill 187, introduced by Delegate Kelly Convirs-Fowler with co-patrons Delegates Terry Kilgore Askew and Kim Feggans, seeks to amend the charter to authorize 10 council members elected from individual districts and one mayor elected at-large. The measure includes an emergency clause to expedite implementation.
The push for this change stems from a November 2025 referendum where Virginia Beach voters approved, by a solid majority, a question requesting the General Assembly to revise the city charter. The ballot specifically asked if the election method should transition from the prior modified 7-3-1 system to the 10-1 format. City Council unanimously endorsed the voter decision shortly after, voting on November 25, 2025, to support the charter update.
This referendum resolved ongoing issues, including a 2025 court ruling that voided a prior 2023 City Council vote to adopt the 10-1 system due to charter constraints. Proponents of the districts-only structure highlight enhanced accountability, as each council member directly represents a specific neighborhood, ensuring focused attention on local concerns like infrastructure, public safety, and property taxes.
In the House, the bill progressed through the Counties, Cities and Towns Committee, where Subcommittee 1 recommended amendments on January 23, 2026, by a 4-1 vote. The full committee approved reporting with amendments 15-4 on the same day. The House agreed to those amendments and passed HB 187 on January 30, 2026, by an overwhelming 83-13 margin, demonstrating broad support for honoring the voter mandate.
The Senate Local Government Committee reported the bill favorably 10-5 on February 23, 2026. After procedural maneuvers—including a defeat on February 25 by a 25-15 tally and rejection of reconsideration—the Senate passed it the next day, February 26, on a 31-9 vote. Nine senators opposed final passage, reflecting concerns over potential fragmentation of citywide priorities in favor of district-specific agendas.
Opponents in both chambers raised points about the risk of parochial decision-making, arguing that single-member districts could prioritize hyper-local issues over broader fiscal responsibility and unified city planning. Such views align with longstanding preferences for at-large representation to foster a holistic perspective on municipal governance, particularly in managing large-scale projects like beachfront development and military family support in Virginia Beach.
The bill was engrossed by the House as amended, enrolled on March 2, 2026, and signed by Speaker of the House and Senate President pro tempore on the same day. It reached the governor on March 3, with the action deadline set for March 10.
On March 4, the governor issued recommendations, refining the title to explicitly note the emergency aspect and adding provisions after line 72 of the enrolled version. These adjustments aim to streamline the transition without altering the core voter-approved structure.
Virginia Beach’s evolution to the 10-1 system caps years of debate and legal challenges rooted in federal voting rights considerations. Previously, the hybrid model faced scrutiny for allegedly diluting minority influence, prompting the shift. Supporters emphasize that district elections empower residents in underserved areas, compelling council members to address constituent needs directly rather than relying on coalition-building among at-large members.
Conservative voices have underscored the importance of this change in reinforcing representative democracy, as it binds elected officials to specific communities, potentially curbing wasteful spending through heightened scrutiny from localized watchdogs. The strong House passage, including Republican votes, signals confidence that the districts will deliver responsive governance amid rising concerns over property taxes and public services.
As the largest city in Virginia, Virginia Beach’s council structure impacts over 450,000 residents, including a significant military population. The 10-1 setup is expected to debut in upcoming elections, with first district-based contests potentially in 2028.
Lawmakers view HB 187 as a straightforward codification of public will, ensuring legal stability for the city’s electoral framework. With the governor’s recommendations now before the House, final concurrence could solidify the transition imminently, paving the way for more accountable local leadership.
