Adele McClure House Bill 19 Expands Firearm Restrictions After Domestic Assault Convictions
RICHMOND, Va. — The Virginia General Assembly has finalized House Bill 19, a measure that broadens restrictions on firearm purchases, possession, and transportation for individuals convicted of certain misdemeanor assaults. The bill, introduced by Delegate Adele McClure, now awaits action from Governor Abigail Spanberger after both chambers reconciled differences on March 6, 2026.
House Bill 19 expands the definition of ‘family or household member’ in juvenile and domestic relations district courts to include ‘intimate partners.’ This term covers individuals who, within the previous 12 months, engaged in a romantic, dating, or sexual relationship with the offender, determined by the length, nature, frequency, and type of interactions. For firearm-related prohibitions, the bill further includes anyone who currently cohabits or cohabited within the past year with the convicted person.
Under the legislation, effective for offenses committed on or after July 1, 2026, a misdemeanor conviction for assault and battery against an intimate partner — or a substantially similar offense under another state’s or federal law — triggers a ban on knowingly purchasing, possessing, or transporting any firearm. Violating this prohibition constitutes a Class 1 misdemeanor.
The bill progressed through committees with notable opposition. In the House Public Safety Committee, it advanced on a 15-6 vote, referred to Appropriations where a subcommittee recommended reporting 5-2 before full committee approval 15-7. The full House passed it 61-35 on February 12. In the Senate, Courts of Justice reported it with a substitute on a 9-5 vote, Finance and Appropriations followed 10-5. The Senate passed the substitute 22-18 on March 2, but the House rejected it 2-94. The Senate then receded 22-18 on March 6, sending the House version forward. It was enrolled and delivered to the governor on March 10.
Public testimony and comments revealed significant resistance, particularly from gun rights advocates. During subcommittee hearings, opponents argued the measure punishes a non-violent misdemeanor unrelated to firearms, stripping civil rights without due process. The Virginia Citizens Defense League (VCDL) strongly opposed House Bill 19, stating, ‘This bill makes battery in a “dating relationship” a misdemeanor and takes away the right to purchase, possess, or transport a firearm for three years. Misdemeanors should never take away a civil right.’
Hundreds of public submissions on the House of Delegates Speak platform echoed these concerns. Residents from across the commonwealth, including members of VCDL, Gun Owners of America, and the National Rifle Association, labeled the bill an unconstitutional infringement on Second Amendment protections. Commenters highlighted vague definitions prone to abuse in contentious disputes, warning it could disarm law-abiding citizens over minor offenses while ignoring criminals who disregard laws. One submission noted, ‘No one should lose their gun rights over a misdemeanor conviction,’ emphasizing the lack of historical analogues under recent Supreme Court precedents like Bruen.
Many pointed to the bill’s potential for overreach, such as applying to past cohabitants or dating partners without evidence of ongoing threat. Veterans and lifelong Virginians invoked oaths to defend constitutional rights, arguing the measure burdens responsible owners and fails to enhance safety. References to historical disarmaments preceded tyrannies underscored fears of government overreach. Fiscal impact statements from the Virginia Criminal Sentencing Commission and Department of Planning and Budget were issued, though specifics indicated minimal state costs.
Supporters of gun rights contended enforcement of existing laws against violent criminals would prove more effective than broadening prohibitions. The narrow Senate margins, with 18 no votes each time, reflected persistent division. As the governor’s deadline approaches on April 13, the outcome remains uncertain, with advocates urging a veto to preserve firearm freedoms.
The legislation arrives amid broader debates on public safety, where opponents stress focusing resources on mental health, prosecuting offenders harshly, and upholding enumerated rights rather than expanding restrictions. Virginia’s legislative tracker shows House Bill 19 as one of several firearm measures drawing scrutiny, amplifying calls for judicial review if enacted.
