Virginia Legislature Unanimously Passes House Bill 100 to Standardize Small Estate Affidavit Forms

RICHMOND, Va. — The Virginia General Assembly has sent House Bill 100 to Governor Abigail Spanberger’s desk after unanimous passage in both chambers, marking a significant step toward standardizing the process for handling small estates across the commonwealth.

Introduced by Republican Delegate Jason Ballard of District 42, HB 100 amends Section 64.2-601 of the Code of Virginia to require that affidavits for the payment or delivery of small assets be presented on a uniform form prepared by the Office of the Executive Secretary of the Supreme Court of Virginia. This change aims to create consistency in the paperwork used statewide when successors claim assets from a decedent’s personal probate estate valued at $75,000 or less.

Small assets under the Virginia Small Estate Act include items such as bank accounts, checks, stocks, or other personal property that can be transferred without full probate proceedings. Currently, the process requires an affidavit from all known successors affirming key details: the estate’s total value does not exceed $75,000, at least 60 days have passed since the decedent’s death, no personal representative has been appointed, the will (if any) has been probated, and the designated successor’s entitlement and fiduciary duties. Financial institutions and transfer agents must honor these affidavits upon presentation, discharging them from further liability.

The bill addresses variations in affidavit forms used by different circuit court clerks’ offices, which have led to inconsistencies and potential delays. Clerks have noted that a standardized form would streamline operations and reduce errors in processing these common estate transfers, particularly beneficial for families settling modest estates quickly.

HB 100 progressed rapidly through the legislative process. Prefiled on January 14, 2026, it was referred to the House Courts of Justice Committee, where a subcommittee recommended reporting it unanimously on January 28 (10-0). The full committee followed suit on February 4 (22-0), prompting swift floor action. The House passed it on February 10 by a block vote of 98-0. In the Senate, the Courts of Justice Committee reported it favorably on February 18 (14-0), with constitutional readings dispensed and passage on February 23 (38-0 block vote). The enrolled bill reached the Governor on March 10, with action due by April 13.

Fiscal impact statements from the Department of Planning and Budget confirm no material statewide costs. The Office of the Executive Secretary anticipates any minor expenses, such as form development and distribution, will be absorbed within existing resources.

Delegate Ballard, an attorney and veteran representing Giles, Craig, and parts of Montgomery and Roanoke counties, chairs the House Courts of Justice Civil Subcommittee. His sponsorship underscores a focus on practical legal reforms that ease administrative burdens on citizens. Ballard’s legislative updates highlighted HB 100 alongside other measures advancing through committees, reflecting priorities on efficient government processes that support families and property rights.

The unanimous support in committees dominated by experienced lawmakers signals broad agreement on the merits of uniformity in probate procedures. This is especially relevant in rural areas like District 42, where timely access to small assets can aid survivors in managing immediate financial needs without protracted court involvement.

Proponents view the measure as a commonsense update to the Small Estate Act, originally enacted to simplify transfers for low-value estates and avoid the expense and time of formal qualification. By mandating a single statewide form, HB 100 ensures holders of small assets—banks, brokerages, and others—can confidently process claims, reducing hesitation stemming from form discrepancies.

As the bill awaits the Governor’s review, its passage exemplifies legislative consensus on targeted improvements to Virginia’s legal framework. If signed, the uniform affidavit will take effect, providing clarity and efficiency for thousands of Virginians annually navigating end-of-life asset distributions. The reform aligns with ongoing efforts to modernize probate laws while safeguarding fiduciary responsibilities and successor rights under existing statutes.

With no amendments during its journey, HB 100 stands as a model of streamlined lawmaking. Its fiscal neutrality further bolsters its appeal, ensuring no added taxpayer burden for implementation.
