Senate Finance Committee Continues Katrina Callsen House Bill 127 on Right to Counsel at Bail Hearings
RICHMOND, Va. – Legislation aimed at ensuring appointed counsel for individuals appearing in court without bail has hit a roadblock in the Virginia Senate, as the Finance and Appropriations Committee voted to continue House Bill 127 to the 2027 session. The measure, which passed the House of Delegates with strong bipartisan backing, seeks to standardize procedures for providing legal representation during initial court appearances in jurisdictions equipped with public defender offices.
Introduced by Delegate Katrina Callsen, HB127 targets a critical juncture in the criminal justice process: the first court appearance for persons held in custody without bond. Under current law, such defendants in districts with public defenders must have counsel appointed, but the bill strengthens this by requiring, where practicable, sufficient time for attorneys to confer with their clients before bail hearings. This provision aims to facilitate informed judicial decisions on pretrial release, potentially safeguarding public safety by allowing defense counsel to present relevant information promptly.
The bill also extends flexibility to localities lacking public defender offices, permitting them to adopt similar protocols voluntarily. To guarantee statewide compliance, each circuit’s chief judge must submit a detailed implementation plan by November 1, 2026. Most provisions would take effect January 1, 2027, allowing time for judicial circuits to prepare without abrupt disruptions to court operations.
HB127 navigated the House swiftly and decisively. Prefiled on January 2, 2026, and referred to the Courts of Justice Committee, it received a fiscal impact statement from the Department of Planning and Budget on January 21. The Criminal Subcommittee unanimously recommended reporting it with a substitute on January 28 (9-0), followed by the full Courts of Justice Committee’s 22-0 approval on February 4, sending it to Appropriations.
In Appropriations, the General Government and Capital Outlay Subcommittee endorsed amendments on February 6 (7-0), and the full committee reported it with amendments on February 9 (21-1). The House agreed to the Courts of Justice substitute and Appropriations amendments during floor consideration on February 12, engrossing the bill before passing it on February 13 by a vote of 84-10. This lopsided margin underscores broad agreement on bolstering procedural safeguards in pretrial proceedings.
The bill crossed over to the Senate on February 16, where the Courts of Justice Committee reported a substitute on February 23 (11-3), rerouting it to Finance and Appropriations. Despite this progress, the committee opted to continue the measure to 2027 on March 3 (13-0 with one abstention), effectively pausing its advancement in the current session.
Proponents highlight HB127’s alignment with constitutional mandates for right to counsel, as enshrined in the Sixth Amendment and Virginia’s own legal traditions. By mandating pre-hearing consultations, the legislation promotes thorough bail determinations, reducing risks of premature releases or prolonged detentions based on incomplete information. Judicial planning requirements empower local chief judges to tailor solutions, preserving circuit-level autonomy while enforcing uniformity where public defenders operate.
Multiple fiscal impact analyses from the Department of Planning and Budget, issued throughout the process, informed lawmakers on budgetary implications, ensuring fiscal prudence amid ongoing concerns over state spending. Racial and ethnic impact statements from the Joint Legislative Audit and Review Commission further vetted the bill’s equitable application.
Amendments refined the proposal, including House subcommittee changes and Senate substitutes, demonstrating legislative craftsmanship to address practical concerns. As Virginia grapples with balancing swift justice and individual rights, HB127 represents a measured step toward a more reliable pretrial framework.
With the 2026 session winding down, the continuation signals Senate priorities on appropriations but leaves the door open for resumption next year. Stakeholders in the judiciary and law enforcement await potential revival, viewing the bill as essential for upholding the rule of law in everyday courtrooms across the Commonwealth.
